By using pn.com, you agree to these Terms of Service. This website is owned and operated by PN, LLC, a Delaware limited liability company registered to do business in Nevada.

1. Acceptance of Terms

By accessing or using any services provided by PN, LLC ("PN®," "PNDOTCOM™," "PN.COM™," "we," "us," or "our"), including our website, web-based operating system, consultation services, and any other products or services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.

By accessing or using our experimental services, you acknowledge that you have read and understood the Experimental and Development Software Notice in Section 3 and accept all associated risks. If you do not accept these risks, you must immediately discontinue use of our services.

2. Description of Services

PN provides various technology services including but not limited to:

  • Web-based operating system portal
  • Hardware and software tools for privacy and security
  • Educational courses and training
  • Security consultation services
  • Custom programming and development
  • Privacy-focused technology solutions

3. Experimental and Development Software Notice

Important: The PN Web OS and related services are experimental software in active development. By using these services, you acknowledge and agree that:

a) Development Status:

The software is in continuous development and may be considered alpha, beta, or pre-release quality. Features, functionality, and performance are subject to change without notice.

b) No Stability Guarantees:

The software may contain bugs, errors, design flaws, and other problems that could cause system crashes, data corruption, data loss, or other malfunctions. The software may be incomplete and may contain errors that could cause failures.

c) Data Loss Risk:

YOU ASSUME ALL RISK OF DATA LOSS.

While we implement encryption and storage features, there is no guarantee that your data will be preserved, accessible, or recoverable. You are solely responsible for maintaining backups of any important data outside of our services.

d) Service Availability:

We make no guarantees regarding uptime, availability, or continuous operation. Services may be interrupted, suspended, or discontinued at any time without notice for maintenance, updates, or any other reason.

e) Feature Changes:

Features may be added, modified, or removed at any time without notice. APIs, interfaces, and functionality are subject to breaking changes. Documentation may be incomplete or outdated.

f) Browser Compatibility:

The software relies on modern browser features including but not limited to IndexedDB, WebAssembly, WebRTC, and other experimental web APIs that may not be supported or may function differently across browsers and devices.

g) Security Considerations:

While we implement security measures, experimental software may contain undiscovered vulnerabilities. The peer-to-peer, WebRTC, and IPFS features involve direct connections with other users which carry inherent risks.

h) No Production Use:

THE SOFTWARE IS NOT INTENDED FOR PRODUCTION, MISSION-CRITICAL, OR COMMERCIAL USE.

Do not use these services for any purpose where failure could result in financial loss, legal liability, personal injury, or damage to property.

i) User Acknowledgment:

BY CONTINUING TO USE OUR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE BEEN WARNED OF THE EXPERIMENTAL NATURE OF THE SOFTWARE AND VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH ITS USE.

4. User Obligations

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use our services for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Transmit any malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt our services or servers
  • Collect or harvest any personally identifiable information from our services
  • Use our services to infringe upon the rights of others

5. Privacy and Data Protection

Your use of our services is also governed by our Privacy Policy. We are committed to protecting your privacy and maintaining the security of your personal information. We collect only the minimum data necessary to provide our services and never sell your information to third parties.

6. Intellectual Property Rights

All content, features, and functionality of our services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, are the exclusive property of PN, LLC or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

7. User-Generated Content

If you submit, upload, or post any content to our services, you grant PN a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media, while respecting your privacy rights.

8. Disclaimers

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our services will be uninterrupted, error-free, secure, or free from viruses or other harmful components. You use our services at your own risk.

Additionally, we specifically disclaim any warranties regarding:

  • The stability, reliability, or error-free operation of experimental features including but not limited to WebAssembly compilation, peer-to-peer networking, IPFS integration, and blockchain explorers
  • The preservation, integrity, or recoverability of data stored in browser storage (IndexedDB, localStorage)
  • The compatibility of services with any particular browser, device, or operating system
  • The continued availability of any feature, service, or functionality
  • The accuracy or reliability of any encryption, security, or privacy features in preventing unauthorized access or data breaches
  • The performance or functionality of third-party services, APIs, or protocols integrated into our platform

THE EXPERIMENTAL NATURE OF OUR SOFTWARE MEANS IT MAY FAIL AT ANY TIME. YOU ACKNOWLEDGE THAT YOU USE THE SOFTWARE ENTIRELY AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PN, LLC AND ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OUR SERVICES.

In addition to the above limitations, PN, LLC specifically shall not be liable for:

  • Any loss or corruption of data, whether encrypted or unencrypted
  • Any failure of experimental features or development-stage functionality
  • Any incompatibility with browsers, devices, or systems
  • Any changes to or removal of features without notice
  • Any security breaches or unauthorized access resulting from experimental features
  • Any damages resulting from the use of peer-to-peer, WebRTC, or decentralized technologies
  • Any losses resulting from reliance on the software for production or commercial purposes

YOU EXPRESSLY AGREE THAT YOUR USE OF THE EXPERIMENTAL SOFTWARE IS AT YOUR SOLE RISK AND THAT YOU ASSUME FULL RESPONSIBILITY FOR ALL RISKS ASSOCIATED WITH ITS USE, INCLUDING BUT NOT LIMITED TO THE RISK OF COMPLETE DATA LOSS, SYSTEM FAILURE, OR SECURITY COMPROMISE.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above exclusions may not apply to you. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

10. Indemnification

You agree to defend, indemnify, and hold harmless PN, LLC and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of our services.

11. Termination

We reserve the right to terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use our services will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Nevada, without regard to its conflict of law provisions. You agree that any legal action or proceeding related to our services shall be brought exclusively in the courts located in Carson City, Nevada, and you consent to the jurisdiction and venue of such courts.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on our website prior to the change becoming effective. Your continued use of our services after any such changes constitutes your acceptance of the new Terms.
